I WAS a Bank of America employee whose employment was TERMINATED WHILE ON MEDICAL LEAVE --- ILLEGAL!
  • I went out on medical leave approved by my Doctor and the State and my Insurance on November 2, 2011. My Banking Center Manager called Bank of America Human Resources and told them I was on an unauthorized leave of absence and she terminated my employment WITHOUT CALLING ME FIRST!! It wasn't until I got out of the hospital that I found out I no longer had a job. This is completely against the FMLA Federal Law Regulations!

  • Not quite sure what you mean by "approved." Do you mean you cleared it all through your HR department with your doctor's signature? There should be a paper trail with HR already, so I'm wondering how it can be your manager's word against you. I mean, it's still a crappy thing to do, to terminate you when you are ill, rather than walk you through what you need to do to make your leave of absence official, but I'm just wondering if they actually violated the law or not. There is a process that you have to go through to get approved for medically necessary leave of absence. A lot of people do not know that, they think those rights are automatically conferred.
  • This happens all the time. They feel that THEY are the ones to tell you if you can go on leave and NOT your doctor. When you do go on leave, you are met with the cold shoulder when you return and therefore overstressed once again and forced to go on leave. It is a hideous cycle.
  • Poor leadership ability of the manager to not have been checking in a sick employee and to help them out with starting the administration process internally within BOA. 
  • Go get a lawyer, sue the piss out of em! Give em hell!

  • This is interesting because i was on leave for pneumonia and it was approved by aenta and by the way aetna has to be the worst insurance company to deal with to get your FMLA approved. i came back to work and by law there not suppose to give you any occurances while your out on approved leave. Came back and they did they gave me a few occurances and my supervisor to me in saying i had 8.5 occurances and i was let go. I was really upset by this So i seeked a lawyer and thats how im handling it because i wont let BOA get away with this because its increidbly againest the law what they did and now i cant get a job for the life of me.
